New pool regulations in Québec

Have you heard about the new swimming pool codes that go into effect in 2025? These regulations are designed to improve safety and reduce the risk of drowning. Here are the key points to remember to make sure you are in compliance.

When do these new rules go into effect?

The new regulations for swimming pools will come into force on January 1, 2025. Owners of existing pools will have until that date to comply with the new requirements.

We advise you to plan ahead, as construction contractors will undoubtedly be in high demand during this period.

Who is it for?

First of all, all residential outdoor pools that hold 60 cm or more of water must be secured. This applies to all types of pools, whether they are above ground, in-ground, or even portable (inflatable or otherwise).

This regulation no longer takes into account the date of installation of the pool. Previously, owners of pools installed before November 1, 2010 were exempt: they now have until September 30, 2025 to comply.

All future pools must also comply with the new rules.

New rules

  • In-ground and semi-in-ground pools: Fencing around the pool is mandatory.

  • Above-ground pools: Above-ground pools measuring less than 1.2 m in height must be enclosed by a fence.

  • Portable pools: Portable pools measuring less than 1.4 m in height must be enclosed by a fence.

  • Fences: Fences must be at least 1.2 m high to prevent access by small children. They must prevent the passage of a 10 cm diameter ball (between the bars or between the ground and the bottom of the enclosure). 2 They must also be designed in such a way that they cannot be easily climbed. If the fence is made of chain link, the links should measure 30 mm or less. Otherwise, slats should be integrated into the links. Moreover, shrubs or hedges do not qualify as fencing. If you have access to your pool from a platform, a fence with a safety gate must be installed either at the bottom of the platform or on top of it. If you have access to your pool from a deck attached to your home, you’ll need to install a fence with a safety gate on the deck between the house and the pool.

  • Doors and gates: Under the new pool regulations, doors and gates leading to the pool area must be fitted with automatic locking mechanisms. A safety latch must also be installed on the pool side. However, it is possible to install the latch on the outside of the pool, if it is at least 1.5 m high. The gate must have the same characteristics as the fence.

  • Safety barriers: For above-ground and semi-in-ground pools, safety barriers must be installed on the pool walls.

  • Ladders and stairs: In-ground pools must have ladders or stairs with handrails for easy entry and exit.

  • Spa covers: The regulations include spas. These must be fitted with secure screw-on covers, to prevent them from being easily opened by children.

Around the pool

Filtration and water heating systems should be installed more than 1 metre from the edge of an above-ground pool or on the outside of the fence. Otherwise, you'll need to make sure they're under the deck or patio, inside the fenced area, or in a shed. You'll also need to make sure that the pipes connecting the systems to the pool are flexible and not installed in a way that makes it easy to climb the fence or pool wall. Finally, you'll need to make sure that there are no fixed structures or equipment that can be used to climb the pool wall or fence within (1 meter) of the pool. Think of a play set or a swing set, for example. If you want to install a diving board, your pool must be deep enough and have the dimensions required (available in French only) for safe diving.

Accident insurance (drowning)

  • Mandatory insurance: The new rules include a section on insurance. Pool owners will have to take out insurance to cover accidents and drowning. This insurance must include coverage for medical expenses and bodily injury.

  • Regular inspection: Insurers may require regular inspections to verify compliance with safety standards.

New pool regulations: it’s all about safety
